Dear Clients,
We hold your security with the highest regard and for your ‘peace of mind’, we’ve prepared a detailed outline of the Reservation Terms and Conditions. Please take the time to familiarize yourself with the provisions below before your booking, as their acceptance will enable you to book your reservation and at the same time authorizing the Operator (NetMedia S.A.) to execute your booking.
I. The colloquialisms outlined in this agreement are defined as the following:
ORDER – a virtual document; which is the only alternative used when a making reservations in the www.hotelwarsaw.com system.
RESERVATION – an accepted order confirmed by the Operator of the services requested (for example an overnight hotel stay).
CLIENT – a physical or legal body, bound by the laws of the Civil Code, benefiting from the services provided by NETMEDIA S.A.
OPERATOR – NETMEDIA S.A. with its headquarters located on 15 Woronicza Street, 02-625 Warsaw.
VOUCHER – a document verifying the acceptance of the Reservations Terms and Conditions and booked services ordered by the Client on the www.hotelwarsaw.com system. This document is indispensable and must be presented at the hotel in order to consume the booked reservation.
II. SUBJECT AGREEMENT
1. The subject agreement is an intermediate in services of hotel overnight booking in Hotels and other such facilities as well as the reservation of other tourism services through the operator on behalf of the client.
2. The Reservation of overnight accommodation is executed via the electronic reservation system accessible on the following address: www.hotelwarsaw.com
III. RESERVATION OF SERVICES
1. The purchase of overnight accommodation or other tourism services is executed by means of the completion and dispatch of the Order form.
2. The client is obligated to complete the Order form correctly. The Operator does not take any responsibility for the aftereffects resulting from the incorrect completion of the Order form by the Client.
3. It is the responsibility of the Client to verify whether the VOUCHER, confirmation of the service booked, was received successfully. In the case where this document is not received, the Operator must be informed of this fact as soon as possible by the Client.
4. The Operator does not guarantee a successful delivery of the reservation confirmation document and does not take responsibility for the aftereffects resulting from a missing Voucher during the acodation of the Client at the hotel.
IV. PRICES INCLUDED IN THE SYSTEM
1. The Prices exhibited in the www.hotelwarsaw.com system are per room (apartments, other accommodation) per night. All prices are VAT inclusive.
2. 2. The Prices exhibited in the www.hotelwarsaw.com system include Hotel breakfast. In the case where breakfast is not offered in the price, the Client will be informed of this fact during the reservation process.
3. 3. The Operator of the system informs and the Client accepts that the prices exhibited in the reservation system are subject to change within prior notice or explanation where in the Operator verifies that the price exhibited to the Client, at the moment of processing the reservation, on the confirmation document is the actual price the Client will pay for the service. The Operator does not charge any other additional fees for acting as an intermediate in the reservation of overnight accommodation as well as other tourism services.
V. THE PAYMENT OPTIONS FOR A SERVICE RESERVATION
The only legally binding unit of currency for payments in the system www.hotelwarsaw.com is the Polish Zloty (PLN). The prices presented to the Client in foreign currencies (EURO, USD, GBP) are approximations, converted according to the daily average currency exchange bank price, and are processed accordingly of the day of the reservation. The differences in the sum of the reservation price when a particular Order is made are only subject to the difference in the exchange rate transaction process finalized either by the credit card authorization centre or the Clients bank. There are two different form of payment in the www.hotelwarsaw.com system: credit card payment and bank transfer.
CREDIT CARD
1. The Sum equivalent to the service ordered during the process of formulating of the Order is automatically authorized once the Client has completed the Order via the intermediate system eCard – an authorized credit card centre utilizing an encoded, secure connection. The Operator can block the authorized funds as of the moment of Order confirmation (7 working days from the time of their authorization).
2. The Clients Credit Card will be debited at the moment of confirmation of the Order by the Operator.
3. The Operator has the right and is entitled to reject the Order in the case where the Clients credit card funds are insufficient to cover the costs of the Order or the credit card vendor rejects the transaction operation

System www.hotelwarsaw.com umożliwia Klientowi uregulowanie należności za zamówioną usługę w formie przelewu bankowego przy spełnieniu następujących warunków:
1. Klient dokona płatności, a środki dotrą na konto Operatora w nieprzekraczalnym terminie 3 dni roboczych od daty rozpoczęcia usługi.
2. W przypadku braku środków pieniężnych na koncie Operatora w terminie co najmniej 3 dni roboczych od daty rozpoczęcia usługi, Operator ma prawo anulować zamówioną przez Klienta usługę z przyczyny braku zapłaty w terminie.
3. W momencie otrzymania środków pieniężnych Operator zobowiązuje się do natychmiastowego przesłania do Klienta potwierdzenia usługi wraz z Voucherem. W celu szybszego otrzymania potwierdzenia zamówionej usługi, Klient może przesłać dowód dokonania przelewu na numer faksu 0048 22 815 41 00 lub na adres e-mail bok@hotele.pl
4. Płatności należy dokonać na konto bankowe NETMEDIA S.A. w kredyt Banku Nr rachunku.: 90 1500 1878 1218 7006 4975 0000 w Kredyt Bank. Do rozliczeń poza krajowych można zastosować następujący numer rachunku: (IBAN) PL90 1500 1878 1218 7006 4975 0000 (BIC) KRDBPLPW.
VI. VAT INVOICE
1. The Operator is obligated to issue a VAT invoice within 7 days of the conclusion of the service.
2. According to the goods and services tax bill, the Operator is obligated to issue a VAT invoice.
3. In the case where the Client incorrectly completed or provided false information regarding company information need for a VAT invoice, the Operator reserves the right not to issue a VAT invoice or modify the current VAT invoice with the 7 days of the conclusion of the service.
VII. ADDITIONAL SERVICES
Any other additional services exploited by the Client at the Hotel or at another entity (for example parking, laundromat facilities, cable television, mini-bar, climate tax at various health spa facilities and others) not booked during the reservation of the Order, will be the sole responsibility of the Client and all costs pertinent to the service.
VIII. CONFIRMATION OF RESERVATION – VOUCHER
The www.hotelwarsaw.com system grants the Client a choice of two forms of services partitioned with regard to their accessibility:
1. ON-LINE Services – with regard to when a Client books an Order that is accessible in real-time (online), the system will instantly send a confirmation of the service booked along with the Voucher to the Client to the indicated e-mail address.
2. ON-REQUEST Services – with regard to when a Client books an Order accessible via on-request (available off-line), the Operator has 24 hours (during workdays) and 48 hours (during non-workdays) to confirm the Order, from the moment the Order was completed by the Client.
3. The Client, along with an Order confirmation, also receives a Voucher which is an essential document to be presented at the Hotel verifying the Clients booked service.
4. In the case of where the Client utilizes the bank transfer form of payment for an Order, the Operator will send the Voucher and confirmation documentation only after sum total of the Order is transferred to the Operators bank account.
IX. CANCELATION OR MODIFICATION OF A SERVICE ORDERD
1. 1. Any modifications or cancellations to be made for a particular Order should be executed using the electronic form accessible on the www.hotelwarsaw.com system. The Operator is not obligated to accept any Order changes or cancellations in any other form other than the one stated in this paragraph.
2. 2. Any changes or cancellation made by the Client need to be verified by the Operator in writing.
3. 3. If the conditions of a particular Order do not state otherwise, the Operator will carry out the changes to the Order without any additional costs to the Client.
4. 4. The Terms and Conditions of cancellations may change depending on the Hotel as well as a particular offer. The Operator guaranties to inform the Client of this fact in a clear and concise way during the booking process of the Order. Any overriding cancellation conditions are emphasized during the Ordering process, in the case of where no overriding conditions are listed, the following Terms and Conditions apply:
a) The Operator will not charge the Client where a cancellation of an Order was made at least 72 hours before the day of the commencement of the service.
b) Charges equal to 100% of the cost of the first night stay apply for cancellations or modifications of a Reservation if made less than 72 hours before the day of the service commencement.
c) Charges equal to 100% of the cost of the full stay apply for “no shows” without prior cancellations or modifications of a Reservation.
5. In the case of where the cancellation of the reservation was accurately formulated by the Client, the Operator will reimburse the Client the amount in question, factoring in any cancellation costs resulting from a particular offer or the general reservation Terms and Conditions. The Operator does not take responsibility for the difference in the total sum of the reimbursed service as the amount in questions is positively correlated with the fluctuations of the daily currency exchange rate.
X. OPERATORS RESPONSIBILITY
1. The Operator will endeavor, to the best of its ability, to execute the Order made by the Client as similar in price and standard requested for the period specified in the Order only under the condition that the original reservation made by the Client is unattainable due to circumstance pertaining to the Operator.
2. In the case of where the original Order is unachievable due to factors outside of the control of the Operator, the Operator will set an Order proposal to the Client offering a similar standard and price in the originally specified period.
3. Under circumstances where the Client rejects the alternative proposition of a service similar in price and standard in the period specified previously or alternatively where the Order is unachievable due to factors outside of the control of the Operator, the Operator is obligated to reimburse the Client the full amount of the cost of the Order (exclusive of point XI paragraph 1, indentation d).
4. The Operators sphere of responsibility can not transgress the cost of the Clients Order.
5. After full reimbursement of costs is executed, due to an impossibility of realization of the Order, the Operator is free of any additional claims of action by the Client.
6. The Operator takes pain to present information located in the www.hotelwarsaw.com system as information up-to-date.
XI. LIMITATIONS OF THE OPERATORS RESPONSIBILITY
1. The Operator is not the owner of the information presented on the www.hotelwarsaw.com system, and specifically:
a. The Operator does not take any responsibility for any damages suffered by the Client at the hands of the Hotel staff.
b. The Operator can not be held responsible for incorrect information provided by the Hotel directly on the www.hotelwarsaw.com system.
c. The Operator does not take responsibility for any reparation resulting from ‘no vacancies’ at the hotel or where the Hotel sells more accommodation than it actually holds.
d. The Operator does not take any responsibility for any inconvenience or unpleasant occurrence at the hotel or an other booked entity that result from, for example renovation of heating systems, inaccessibility to recreational services, pool renovation, a water or power shortage and any other similar occurrences.
2. In matters where uncontrollable factors such as ‘higher power’, for example natural disasters, strikes, wars, biohazards and more, where the realization of the Clients Order is impossible, the Operator is released from any responsibility and does not partake in any consequences regarding the legal binding of these Terms and Conditions.
XII. COMPLAINTS
1. Any complaints associated with the stay at the Hotel should be filed with the Hotel at the time of departure or within 48 hours after the completion of the service.
2. Any deficiency in the complaint information associated with the stay at the Hotel, relayed to the Operator within a reasonable time, can greatly affect the competence of the complaint referral.
3. The Operator is obligated to consider every filled complaint within 14 days of its influx.
XIII. PERSONAL INFORMATION
The Client, making and executing the reservation via the Operator, authorizes their personal date to be stored on a secure internal Client archive operated by NETMEDIA S.A. The archived information will only be processed exclusively for the realization of Orders, simplifying the reservation process for future Orders as well as for marketing objectives in conformity with the law dated 29.08.1997. The Client has the right to access and change their personal information at any time.
XIV. THE ACCEPTATION OF THE RESERVATION TERMS AND CONDITIONS
The Client declares that, at the time of making the reservation, the Client has made themselves familiar with the “Terms and Conditions” and is aware of their foreseeable consequences.
XV. XV. IN CONCLUSION
1. The Terms and Conditions were created under the strict guidelines of Polish law. Any claims to its validity should be filled with and are subject to the jurisdiction local court adequate to the Operators territorial boundaries.
2. In the case of where one point of the contract is invalid, this does not affect the remaining points of the contracts “Terms and Conditions’.
3. The Operator reserves the right to change the “Terms and Conditions” with out prior notice.
